Anti-Dumping and Countervailing Duty Investigations

Australia’s anti-dumping and subsidy legislation is based on WTO rules that provide:

  • Where goods are exported to Australia at prices less than those goods are sold in the country of export and such exports are causing, or threatening to cause, material injury to an Australian industry, anti-dumping measures in the form of customs tariffs may be imposed to prevent such injury
  • Where goods being exported to Australia that receive government subsidies in the country of export and such exports are causing, or threatening to cause, material injury to an Australian industry, countervailing duties again in the form of customs tariffs may be imposed to prevent such injury
Andrew has acted in numerous major anti-dumping and subsidy investigations and successfully represented exporters, importers and foreign governments.
